ORDINANCE 2003-11

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CUERO, TEXAS, AMENDING TITLE V, CHAPTER 51, OF THE CITY OF CUERO CODE OF ORDINANCES, SECTION 51.41 SERVICE CHARGERS FOR COLLECTION, SECTIONS (A) AND (B), AND SECTION 51.56 CHARGERS, PRESCRIBING SERVICE CHARGES FOR GARBAGE COLLECTION (RESIDENTIAL/COMMERCIAL SANITATION RATES) AND DISPOSAL AT CITIZENS COLLECTION STATION, AND PRESCRIBING AN EFFECTIVE DATE.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CUERO, TEXAS:

SECTION ONE. That Section 51.41 (A) and (B) of Title V, Chapter 51 of the Code of Ordinances of the City of Cuero, Texas, be and the same is hereby amended to read as follows:

CHAPTER 51.41 SERVICE CHARGES FOR COLLECTION.
(A)       Residential Service.      There shall be charged and collected from each residence within the City, and from each residence outside of the City which receives City solid waste collection service, a minimum billing period collection service charge of $14.89.

(B)       Commercial Service.      There shall be charged and collected from each business establishment within the City, and from each business establishment outside of the City which receives City solid waste collection service, a minimum billing period collection service charge of $77.43.

(1)  

There shall be an additional charge per month for each additional container as follows:

 

Two pickups,

$77.43 for each additional container

 

 

Three pickups,

$116.13 for each additional container

 

 

Four pickups,

$154.86 for each additional container

 

 

Five pickups,

$193.55 for each additional container

(2)  

Commercial customers utilizing 96 gallon poly carts with two (2) pickups per week shall pay $28.78 per month. Commercial customers utilizing a 2 cubic yard container with two (2) pickups per week shall pay $51.86 per month.


(3)  

Commercial customers shall pay a charge of 11.92 per pickup per container for any additional pickups above normal schedule.


(4)  

Open Top Container Fee:

 

Commercial customers utilizing open top containers shall pay $180.57 transportation charge plus cost of disposal assessed by the landfill site.

 

Construction sites utilizing open top containers shall pay $180.57 transportation charge, $2.00 per day rental fee, $36.00 delivery and pickup charge, and the cost of disposal assessed by the landfill site.


(5)  

The City Manager shall have the authority to require any customer disposing of garbage, rubbish or waste to use an open top container as provided for in Section 51.41(B)(4) above or an open end garbage truck. This requirement will be based on the type and quality of the garbage, rubbish or waste disposal of, and will be at the sole discretion of the City Manager.


SECTION 51.36 CHARGES.

(A) Except as otherwise provided herein, no person shall be permitted to place or dispose of any garbage, rubbish, or waste at any Citizens Collection Station except upon payment of disposal charges as follows:


1.  

Minimum charge 200 pounds or less $6.90.

2.  

Charge per ton or portion thereof $69.00.

3.  

Disposal of used oil filters:


(B) Notwithstanding any provisions hereof to the contrary, any resident of the city may by presentation of a paid current utility bill, deliver yard waste and brush cutting to the Citizens Collection Station without charge.


(C) The Citizens Collection Station will not accept the following items:

1.  

Materials classified as hazardous waste.

2.  

Any other materials restricted by landfill and/or Texas Commission on Environmental Quality.


SECTION TWO. This ordinance shall become effective December 1, 2003.

ON MOTION OF COUNCILMEMBER GOODMAN, SECONDED BY COUNCILMEMBER HENDERSON, THAT THE ORDINANCE BE PASSED ON THIRD AND FINAL READING THE 6th DAY OF NOVEMBER, 2003. AYES:        7          NAYES:        0          MOTION CARRIED. FINALLY ADOPTED AND APPROVED THE 6TH DAY OF NOVEMBER 2003.
